Tort Claims

If you have suffered an injury from a slip and fall, boat, motorcycle, all terrain vehicle or car accident, we can help.

A tort claim is a claim for damages arising as a result of a wrongful act, either intentional or negligent, of another person or business.
If you have suffered personal injury from a slip and fall, you may have a claim against either the business or home owner.
Similarly, if you have been injured in a boating or all terrain vehicle accident, you may be able to seek compensation from the owner and/or driver
who caused that accident. In a typical motor vehicle accident case, your claim will be against the driver of the other car or against the driver of the car in which you were travelling as a passenger. There are other potential defendants, such as highway contractors or the manufacturer of your vehicle, and these can be discussed with your lawyer.
Call Daroux Law today for legal assistance with your accident claim.

Things You Should Know About Tort Claims

There are time limits you should be concerned about in bringing any claim for injuries resulting from an accident. These will vary from case to case depending on your circumstances. You should consult with a lawyer to determine what time limits apply to your case. Failure to properly consider these could result in your right to bring a claim being barred as “out of time”.

If you are told your claim is out of time, consult with a lawyer in any event, as soon as possible, as there are circumstances where a claim can be advanced even when it appears to be too late.

The type of damages (payment of money) to which you might be entitled to if injured in a car accident (or other accident) include damages for:

  • Pain, suffering, and loss of enjoyment of life (called non-pecuniary damages);
  • Loss of earnings to date and future loss of earnings;
  • Loss of earning capacity;
  • Out of pocket expenses you have incurred (special damages), and
  • Future treatment or expenses you will incur as a result of your injuries (cost of future care).
